Federal law prohibits the assignment of plan benefits from a plan participant to a non-plan participant, including a spouse or ex-spouse, without a qualified domestic relations order (QDRO). A QDRO is a court order containing special language concerning assignment of that account upon divorce. Note: Assigning an interest in a non-qualified deferred compensation plan to a spouse is accomplished in the domestic relations order (divorce decree).
